Terms and Conditions

1. Introduction

This Terms and Conditions Policy (“Terms”) govern your use of the Sent With Love website and associated services (“Platform”). By accessing or using the Platform, you agree to these Terms and our handling of your personal data.

2. About Sent with Love

Sent With Love PTY LTD (“we”, “us”, “our”) provides an online gift registry platform allowing users (“Registry Holders”) to create, share, and receive monetary contributions toward their gifts or experiences by their “guests”. All payments are processed securely by our third-party payment provider. Sent with Love does not store, hold, or directly process customer funds.

3. Acceptance of Terms

Using our Platform constitutes agreement with these Terms. We may modify them at any time by publishing updated versions. Continued use constitutes acceptance of any revisions.

Sent with Love may suspend, restrict, or terminate access to the Platform (including any account, registry, or transaction) at any time where we reasonably believe it is necessary to:
(a) protect the security or integrity of the Platform;
(b) comply with applicable laws or regulatory obligations;
(c) comply with the requirements of our payment service providers;
(d) prevent fraud, financial crime, misuse, or harm to users; or
(e) respond to a breach of these Terms.

We may take these actions with or without notice, depending on the circumstances. Any disclaimers, limitations of liability, and indemnities in these Terms continue to apply despite any suspension or termination of access.

4. Creating a Registry and Account

  • You must be at least 18 years old and legally capable of entering into contracts.
  • You agree to provide accurate and up-to-date information when creating an account
  • You are responsible for maintaining the confidentiality of your password and account activity.
  • We reserve the right to suspend or terminate accounts for misuse or fraudulent activity.

5. Guest Contributions and Payments

Guests (“Contributors”) may contribute funds toward selected gifts or choose to purchase items independently. All payment transactions are processed securely by our third-party payment provider and are subject to the provider’s own terms and privacy policy. Sent with Love does not access, store, or process payment details.

Sent with Love makes no representation and gives no warranty to any Contributor that the Registry Holder will use any contribution in any particular way or for any particular purpose, or that the contribution will be applied in accordance with any description, intention, or representation made by the Registry Holder.

6. Fees and Charges

Creating a registry is free.

The Fees payable are as published on the Platform and are subject to change from time to time.

A 1.9% Sent with Love platform fee applies to all guest contributions. This fee is deducted from the gifted amount at the time of contribution.

A separate transaction and processing fee applies to guest contributions and is clearly displayed at checkout.

All payments are processed and funds are held securely by our third-party payment provider. Sent with Love does not hold user funds.

Funds are held in the registry holder’s payout account and cannot be withdrawn until 30 days after the registry is created or the registry end date, whichever is later, as part of our fraud prevention and security measures. Once available, funds may be transferred to the registry owner’s nominated bank account.

Once funds have been successfully paid out to the
Registry Holder’s nominated account, Sent with Love has no further custody, control, obligation, or responsibility in respect to that registry account.

7. Refunds and Disputes

Sent with Love enables guests to contribute gifts and funds to couples through an online registry. Payments are processed by third‑party payment service providers and held securely until they become eligible for payout.

Refund availability depends on timing, payout status, and the reason for the refund request.

Guest‑Initiated Refunds

  • A guest may request a refund before funds have been paid out to the couple, provided:
  • The registry payout has not yet been released
  • The transaction is not subject to an active dispute or chargeback
  • The request complies with card network and payment provider rules
  • Where approved:
  • Refunds are issued to the original payment method
  • The refunded amount is deducted from the registry’s pending balance
  • Processing times depend on the payment provider and card issuer
  • Sent with Love reserves the right to decline refund requests that appear fraudulent or abusive.

Once funds have been paid out to a couple, Sent with Love is generally unable to guarantee a refund, as the platform no longer controls the funds.

In these circumstances:

  • Guests may contact the couple directly to request repayment
  • Sent with Love may assist by providing confirmation of the transaction, where appropriate
  • Refunds after payout are not guaranteed and are assessed on a case‑by‑case basis.

Sent with Love may issue refunds at its discretion in limited circumstances, including:

  • Suspected fraud or unauthorised transactions
  • Duplicate or erroneous payments
  • Technical errors
  • Breach of our Terms of Service or Acceptable Use Policy

Where a platform‑initiated refund is issued:

  • The refund will be processed to the original payment method
  • The registry balance will be adjusted accordingly
  • Relevant accounts may be suspended or restricted

If a guest initiates a chargeback through their card issuer:

  • The affected registry will be temporarily frozen
  • Disputed funds will be excluded from payout eligibility
  • Sent with Love may submit evidence to the payment provider

If the chargeback is upheld:

  • The disputed amount (and any associated fees) will be permanently deducted from the registry balance
  • If the chargeback is resolved in favour of Sent with Love:
  • Funds may be reinstated after review

We may update this Refund Policy from time to time. The most current version will be published on our website.

8. Privacy and Data Collection

Sent with Love operates an online platform that allows guests to contribute gifts and funds to couples through a managed registry. We act as a platform service provider and do not operate as a bank or financial institution.

8.1 Information We Collect

We may collect personal information such as your name, email, phone number, registry details, and contribution data. Payment data is processed by our secure third-party payment provider. We may also collect non-personal data (cookies, analytics) to improve user experience. We do not store full credit card numbers. We may collect IP address, pages visited and actions taken on our website, date and time of access.

8.2 How We Use Your Information

We use your data to:

  • Operate and maintain your registry account.
  • Facilitate secure payments via third party payment providers.
  • Send transactional emails and updates.
  • Improve our website experience.
  • Meet legal, regulatory, and compliance obligations
  • We do not sell, rent, or disclose personal data to third parties except as required to deliver our services.

8.3 Data Security

Payments made through Sent with Love are processed by regulated third-party payment service providers. These providers handle payment information in accordance with their own privacy and security obligations. 

We may also share limited personal information with trusted third parties where necessary, including:

  • Identity verification providers
  • Fraud prevention services
  • Hosting and infrastructure providers
  • Professional advisers (legal, accounting)

All third parties are required to protect personal information and use it only for authorised purposes.

9. Cookies

10. Intellectual Property

All content, trademarks, and branding on the Platform are owned by or licensed to Sent With Love PTY LTD. No content may be reproduced or adapted without our written permission.

11. Limitation of Liability

The Platform is provided “as is.” Sent With Love is not liable for indirect or consequential loss or for third-party system failures.

To the fullest extent permitted by law, Sent with Love is not liable for any loss or damage arising from:
(a) any errors or omissions in the Platform, any content made available on or through the Platform, or any content on external websites;
(b) any delay, interruption, suspension, or cessation of access to, or operation of, the Platform or related services; or
(c) any defamatory, offensive, unlawful, misleading, or inappropriate content posted or transmitted by any user.

Any changes to these Terms take effect immediately upon publication on the Platform. Sent with Love will take reasonable steps to notify users of material changes, however it remains the responsibility of each user to review the current version of the Terms, including the effective date. By continuing to access or use the Platform after any update, you are deemed to have accepted the Terms as amended.
