Sent With Love endeavours to make your gift registry experience seamless, secure and flexible. We trust you will love the freedom of choosing any item or experience you can dream of and sharing it with your guests.

These Terms and Conditions govern your access to and use of the website www.sentwithlove.com.au and associated services (“Platform”).

By signing up, accessing or using the Platform, you agree to be bound by these Terms.

1. About the Website

1.1 Introduction and Scope

These Terms and Conditions (“Terms”) govern your access to and use of the Sent With Love website located at www.sentwithlove.com.au and all associated services, features, and functionality (collectively, the “Platform”).

By accessing, creating an account, or using the Platform, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not access or use the Platform.

1.2 Platform Overview

Sent With Love PTY LTD ACN 694269175 (“Sent With Love”, “we”, “us”, “our”) operates an online gift registry platform.

The Platform allows individuals (“Registry Creators”) to:

• Create a personalised registry
• List gifts, experiences, or contribution items
• Share a secure link with invited guests
• Receive monetary contributions toward those items

Guests (“Contributors”) may:

• Contribute funds toward a listed item; or
• Reserve an item and arrange independent purchase outside the Platform.

The Platform is a digital facilitation service only.

1.3 Nature of Transactions

Contributors acknowledge and agree that:

• They are not purchasing goods from Sent With Love.
• They are making a voluntary monetary contribution to the Registry Creator.
• Registry Creators receive monetary funds and decide independently how those funds are used.

Sent With Love does not:

• Sell, supply, warehouse, or deliver physical goods;
• Guarantee that funds will be used in accordance with any registry description;
• Act as agent for the purchase of goods unless expressly stated.

Once funds are transferred to a Registry Creator’s nominated bank account, Sent With Love has no further control over those funds.

Sent With Love does not sell, supply, warehouse, or deliver physical goods.

1.4 Regulatory Position

Sent With Love operates as a digital registry platform.

All regulated payment processing, settlement, wallet infrastructure, transaction monitoring, and financial crime compliance functions are performed by licensed third-party payment service providers.

Sent With Love:

• Does not provide financial services;
• Does not operate as a bank or authorised deposit-taking institution;
• Does not hold or store customer payment credentials;
• Does not provide escrow, stored-value, or trust account services.

1.5 Changes to Terms

We reserve the right to update these Terms at any time.

Updated versions will be published on the Platform and take effect immediately upon publication unless otherwise stated.

Your continued use of the Platform after any update constitutes acceptance of the revised Terms.

1.6 Acceptance of Terms & Platform Controls

Using our Platform constitutes agreement with these Terms.

We may modify these Terms at any time by publishing updated versions. Continued use constitutes acceptance of any revisions.

Sent With Love may suspend, restrict, freeze, or terminate access to the Platform (including any account, registry, payout, or transaction) where reasonably necessary to:

(a) protect the security or integrity of the Platform;
(b) comply with applicable laws or regulatory obligations;
(c) comply with requirements of our payment service providers;
(d) prevent fraud, financial crime, misuse, or harm;
(e) respond to a breach of these Terms.

We may take such action with or without notice depending on the circumstances.

Any disclaimers, limitations of liability, indemnities, and rights relating to fees or disputes survive suspension or termination.

1.7 Intellectual Property

All website content, design, branding, trademarks, logos, software, and materials made available through the Platform are owned by or licensed to Sent With Love PTY LTD.

No content may be reproduced, copied, distributed, modified, or used without prior written consent.

Unauthorised use may result in legal action.

2. Creating a Gift Registry Account

2.1 Eligibility

To create a registry, you must:

• Be at least 18 years of age;
• Be legally capable of entering into binding agreements;
• Provide accurate, complete, and up-to-date information;
• Not be prohibited from using the Platform under applicable laws.

By creating an account, you represent and warrant that the information you provide is true and correct.

2.2 Required Information

Registry Creators may be required to provide:

• Full legal name
• Email address
• Residential address
• Phone number
• Date of birth
• Bank account details for payout
• Government-issued identification for identity verification

2.3 Identity Verification

These checks may include:

• Submission of government-issued photo identification;
• Biometric or liveness verification;
• Sanctions or watchlist screening;
• Bank account ownership verification;
• Fraud risk assessment screening.

Identity verification is conducted to:

• Prevent fraud and financial crime;
• Comply with payment provider requirements;
• Protect Contributors and Registry Creators;
• Maintain the integrity of the Platform.

Failure to complete verification, or failure of verification checks, may result in:

• Delayed payout;
• Temporary account suspension;
• Permanent account termination.

Sent With Love reserves the right to decline payout where verification requirements are not satisfied.

2.4 Account Security

You are responsible for:

• Maintaining the confidentiality of your login credentials;
• All activity conducted under your account;
• Immediately notifying us of any unauthorised access or suspected security breach.

Sent With Love is not liable for loss arising from unauthorised access resulting from failure to safeguard account credentials.

2.5 Registry Close Date and Payout Timing

Registry Creators must nominate:

• A registry close date; and
• A preferred payout date.

However, payout timing remains subject to:

• Completion of identity verification;
• Expiry of fraud and chargeback monitoring periods;
• Compliance approval by payment service providers;
• Absence of unresolved disputes or investigations.

Sent With Love reserves the right to delay payout where reasonably necessary to manage fraud risk, dispute exposure, regulatory requirements, or payment provider obligations.

2.6 Suspension & Termination

We may suspend, restrict, freeze, or terminate an account or registry where:

• Fraud or suspicious activity is detected;
• Information provided is false, incomplete, or misleading;
• Identity verification fails or cannot be completed;
• There is suspected breach of applicable law;
• These Terms are violated;
• Required compliance checks cannot be satisfied.

We may take such action with or without prior notice depending on the circumstances

Suspension or termination does not remove any obligations relating to fees, chargebacks, disputes, or indemnities arising prior to termination.

 3. Guest Contributions & Payment Processing

3.1 Payment Processing

All payments made through the Platform are processed securely by licensed third-party payment service providers.

Sent With Love:

• Does not store full card details;
• Does not process card payments directly;
• Does not operate a bank account, stored-value facility, or wallet for users;
• Does not hold customer funds on trust or escrow.

Payment transactions are subject to the terms, conditions, and rules of the relevant payment service provider and applicable card networks.

Settlement timeframes are determined by the payment provider and may vary.

3.2 Nature of Contributions

All contributions made through the Platform are voluntary gifts from Contributors to Registry Creators.

Contributors acknowledge and agree that:

• Payments are final, subject only to applicable card network and payment provider rules;
• Contributions are not purchases of goods or services from Sent With Love;
• Registry Creators independently determine how funds are used;
• Sent With Love makes no representation or warranty regarding how funds will be applied.

Once funds are transferred to a Registry Creator’s nominated bank account in accordance with payout conditions, Sent With Love has no further control over or responsibility for those funds.

3.3 Fraud & Chargebacks

In the event of:

• Chargebacks initiated through a card issuer;
• Payment disputes;
• Suspected unauthorised transactions;
• Fraud investigations;
• Regulatory or compliance reviews;

the affected registry may be subject to risk controls, including:

• Temporary freezing of registry balances;
• Exclusion of disputed amounts from payout eligibility;
• Reversal of transactions;
• Deduction of disputed amounts and associated fees from current or future payouts.

Sent With Love may submit transaction evidence to the payment provider in response to chargebacks.

If a chargeback or dispute is upheld:

• The disputed amount and any associated fees may be permanently deducted from the registry balance.

If a dispute is resolved in favour of Sent With Love:

• Funds may be reinstated following review and settlement confirmation.

Sent With Love reserves the right to delay payout where reasonably necessary to manage dispute exposure, fraud risk, or compliance obligations.

4. Fees and Charges

4.1 Registry Creation

Creating a registry on Sent With Love is free.

There are no upfront listing, subscription, or setup fees to create or publish a registry on the Platform.

4.2 Platform Service Fee

• Sent With Love charges a flat 1.9% platform service fee on the total gross value of all monetary contributions received through a registry.
• The 1.9% fee applies to all registries, regardless of size.
• The fee is calculated on the gross contribution amount before any deductions.
• The platform service fee is deducted from the registry balance at the time of payout to the Registry Creator.
• The platform service fee compensates Sent With Love for providing:
• Access to and use of the registry technology platform;
• Platform hosting and infrastructure;
• Compliance oversight and identity verification processes;
• Fraud prevention, monitoring, and risk management systems;
• Customer support and operational services.
• The platform fee is non-refundable once contributions have been processed.

4.3 Payment Processing Fees

Payment processing fees:

• Are charged at checkout to Contributors;
• Are determined by the licensed third-party payment service provider;
• Are displayed transparently prior to payment confirmation;
• Are separate from the Sent With Love platform service fee.

Sent With Love:

• Does not set card network interchange rates;
• Does not retain card processing fees;
• Does not control payment provider pricing structures.

Processing fees may be non-refundable in the event of refunds, reversals, or chargebacks, subject to payment provider rules.

4.4 Payout Calculations

Payouts to Registry Creators will equal:

Total cleared contributions
minus:

• The 1.9% Sent With Love platform service fee;
• Applicable payment processing fees (where relevant);
• Any chargebacks, disputes, reversals, or associated fees;
• Any approved refunds;
• Any applicable reserve amount (if required under Section 4.5).

Payout timing remains subject to the conditions set out in Section 2 (Creating a Gift Registry Account).

4.5 Reserves and Adjustments

Sent With Love reserves the right to apply a temporary reserve, delay payout, or adjust payout amounts where reasonably necessary to manage:

• Chargebacks;
• Payment disputes;
• Fraud risk;
• Regulatory or compliance requirements;
• Payment provider obligations.

Any reserve applied will:

• Be proportionate to the assessed risk;
• Be retained only for as long as reasonably necessary;
• Be released once the relevant risk exposure period has passed.

Sent With Love may also deduct amounts from current or future payouts where necessary to recover:

• Chargebacks;
• Associated dispute fees;
• Fraud-related losses;
• Amounts owed under these Terms.

5. Payout of Registry Funds

5.1 Payout Conditions

Payouts are subject to:

• Completion of identity verification
• Compliance approval
• Fraud monitoring windows
• Absence of unresolved disputes

5.2 Timing

Payout timing is determined by:

• The nominated registry close date
• Internal fraud risk controls
• Payment provider settlement cycles

5.3 Right to Withhold

We reserve the right to:

• Delay payout
• Freeze registry balances
• Reverse transactions

Where required by law, compliance obligations, or fraud risk management.

6. Refunds & Disputes

6.1 General Policy

Contributions made through the Sent With Love platform are voluntary gifts intended for the Registry Creator associated with the registry.

Contributors should carefully review the registry details before completing a contribution.

As a general rule, contributions are non-refundable once processed, except as required under applicable law or payment network rules.

6.2 Refund eligibility

While contributions are generally non-refundable, Sent With Love may consider refunds in limited circumstances including:

• Duplicate payments
  • Payment processing errors
  • Unauthorised or fraudulent transactions
  • Technical system errors resulting in incorrect charges

Refund requests must be submitted within 14 days of the transaction date unless exceptional circumstances apply.

6.3 Chargebacks and Payment Disputes

If a Contributor initiates a chargeback or payment dispute:

• The associated registry payout may be temporarily frozen while the dispute is investigated. Disputed funds will be excluded from payout eligibility;
• Sent With Love may request information from the contributor or registry creator to assist in resolving the dispute.
• Sent With Love will cooperate with its payment service provider in responding to chargeback requests.

If a chargeback is upheld, the disputed amount may be deducted from registry funds where applicable.

6.4 Registry Payout Protection

To protect contributors and registry creators, Sent With Love applies internal risk controls including:

• Holding periods before registry payouts are released
  • Identity verification of registry creators prior to payout eligibility
  • Bank account validation checks
  • Temporary payout freezes where disputes or unusual activity are detected

These controls help ensure contributions are transferred securely and appropriately.

6.5 Registry Cancellation

If a Registry Creator chooses to cancel their registry:

• Pending funds may be returned to Contributors (less non-refundable processing fees); or
• Paid out to the Registry Creator subject to identity verification, compliance approval, and absence of unresolved disputes.

Processing fees are non-refundable unless otherwise required by law.

Sent With Love reserves the right to delay cancellation or payout where required to manage fraud risk, disputes, or compliance obligations.

6.6 Contact for Refund Requests

If you believe a transaction has been made in error, please contact Sent With Love before initiating a chargeback with your bank so we can assist in resolving the issue quickly.

7. Privacy

Sent With Love operates as a digital platform service provider that enables guests to contribute funds to registry creators. We are committed to protecting your personal information and handling it responsibly.

7.1 Information We Collect

We may collect personal and technical information including:

• Identity information (such as full name and date of birth);
• Contact details (such as email address, phone number, and residential address);
• Registry details and content created by Registry Creators;
• Contribution records and transaction history;
• Bank account details for payout purposes;
• Identity verification information where required;
• Device, browser, IP address, analytics data, and website usage activity;
• Communications with us (including email correspondence and support requests).

Payment card details are processed securely by licensed third-party payment service providers. We do not store full credit card numbers.

7.2 Use of Information

We use personal information to:

• Operate, maintain, and administer the Platform;
• Create and manage registry accounts;
• Facilitate secure payment processing through licensed providers;
• Conduct identity verification where required;
• Prevent fraud, misuse, and unauthorised activity;
• Monitor disputes and chargebacks;
• Comply with legal, regulatory, and compliance obligations;
• Improve the functionality and security of the Platform;
• Communicate important service-related information.

We do not sell or rent personal information to third parties.

7.3 Sharing of Information

We may share limited personal information with trusted third parties where reasonably necessary, including:

• Licensed payment service providers;
• Identity verification providers;
• Fraud monitoring and risk assessment services;
• Hosting and infrastructure providers;
• Professional advisers (legal, accounting, compliance);
• Government authorities or regulators where required by law.

All third parties are required to handle personal information securely and use it only for authorised purposes.

7.4 Data Security

We take reasonable technical and organisational measures to protect personal information, including:

Payment information is handled exclusively by regulated third-party payment providers in accordance with their security and compliance obligations.

• Enforce these Terms;

9. Limitation of Liability

The Platform is provided “as is.”

To the maximum extent permitted by law, Sent With Love is not liable for:

• Indirect or consequential loss
• Third-party system failures
• Payment processor outages
• Delays in settlement
• Actions of Registry Creators or Contributors

Our total liability is limited to the amount of platform fees paid.
